Trademarks

COMMENCEMENTCONNECTIONS, the linked-C logo with a mortarboard and all other product or service names or slogans displayed on the Site are registered and/or common law trademarks of Commencement Connections and/or its displayed hotels and universities colleges, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Commencement Connections or the applicable trademark holder. In addition, the look and feel of the Site, including all page headers, custom graphics, button icons and scripts, is the service mark, trademark and/or trade dress of Commencement Connections and may not be copied, imitated or used, in whole or in part, without the prior written permission of Commencement Connections. All other trademarks, registered trademarks, product names and company names or logos mentioned in the Site are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by Commencement Connections.

Limited License

Commencement Connections grants you a limited, nonsublicensable license to access and use the Site and to view, copy and print portions of the Site Content. Such license is subject to these Site Terms, and specifically conditioned upon the following: (i) you may only view, copy and print portions of the Site Content for your own informational, personal and non-commercial use; (ii) you may not modify or otherwise make derivative uses of the Site or the Site Content, or any portion thereof; (iii) any displays or printouts of Site Content must be marked "(c) 2009-10, Commencement Connections Inc. Unless explicitly stated herein, nothing in these Site Terms may be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. You represent and warrant that your use of the Site and the Site Content will be consistent with this license and will not infringe or violate the rights of any other party or breach any contract or legal duty to any other parties, or violate any applicable law. This limited right may be revoked at any time. Copyright Complaint Policy

Infringement Notification:

If you believe in good faith that materials hosted by us infringe your copyright, please provide the written information requested below. The procedure outlined below is exclusively for notifying Commencement Connections that your copyrighted material has been infringed.

Please provide the following information in the following format (including Section Numbers):

1. A clear identification of the copyrighted work you claim was infringed.

2. A clear identification of the material you claim is infringing the copyrighted work, and information that will allow us to locate that material on the Website, such as a link to the infringing material.

3. Your contact information so that we can reply to your complaint, preferably including an email address and telephone number.

4. Include the following statement: "I have a good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law."

5. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."

6. The notice must be signed by the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Cancellation and Schedule Change Policy

Shuttle Ticket Cancellation Policy

Cancellation. The following cancellation policy shall apply to Shuttle Tickets purchased at www.commencementconnections.com.

1. For Cornell all Shuttle tickets purchased through www.commencementconnections.com (Cornell Commencement and Conference and Convention tickets), cancellation notices must be emailed to balance@commencementconnections.com no less than fourteen (14) business days in advance of the day said services are to be delivered, in order to be eligible for a refund, minus a 35% of the total charge for each one-way ticket, and minus 50% of the total charge for each round-trip ticket purchased. Commencement Connections is not responsible for any error in the delivery of the email notice.

If the customer (guest) has purchased (a) Shuttle ticket(s) through www.commencementconnections.com, and a cancellation notice emailed to balance@commencementconnections.com is received within (14) business days prior to the day said services are to be delivered, the customer (guest) will be charged for the full Shuttle ticket(s) fee(s). In other words, customer (guest) is not entitled to a refund if cancellation notice emailed to balance@commencementconnections.com is received less than (14) business days in the day said services are to be delivered. Commencement Connections is not responsible for any error in the delivery of the email notice.

2. Commencement Connections reserves the right to reschedule or cancel the date, time and location of any shuttle, including replacing personnel who may be scheduled to drive or meet the shuttle at any time. In the event a Shuttle is cancelled and does not provide service to customers (guests) at a specific hotel, airport, or other specified location within 1.5 hours of the agreed upon time (time specified at time of customer purchase), the customer is entitled to a full refund. Commencement Connections shall not be responsible for any other loss incurred by Customers (guests) as a result of a cancellation or reschedule.

3. Commencement Connections shall not be liable or responsible for any loss as a result of a Shuttle delay. Due to the nature of the business, Shuttles may be delayed by up to 1.5 hours, or more, however unlikely. Commencement Connections reserves the right to reschedule any Shuttle by up to 1.85 hours, without penalty, in normal safe and unsafe driving conditions; Commencement Connections cannot be held liable for any delays due to excessively large traffic delays and poor road conditions. Customers (guests) shall not be entitled to any refund, and Commencement Connections shall not be liable or responsible for any loss as a result of a Shuttle rescheduling or delay of 1.85 hours or less. Customers (guests) will have the option to receive a full refund if a Shuttle is rescheduled by more than 1.85 hours; unless the rescheduling is caused by unforseen inclement weather, dangerous road conditions, natural disasters, and other unforseen events that prevent normal driving conditions. Commencement Connections will notify customers (guests) of reschedule changes in advance via email, and Commencement Connections is not responsible for any error in the delivery of the email notice. If we believe the email did not go through, we will resend the notification, then call the number provided by the customer (guest).

4. In the event of Severe Weather, Commencement Connections may need to reschedule Shuttles by as much as four hours in order to best accommodate customers (guests), and as long as Shuttle service is being offered to someone at the same hotel or airport on the same day, customers at that hotel or airport are not entitled to a refund, and Commencement Connections shall not be liable or responsible for any loss as a result of a Shuttle delay or rescheduling. Commencement Connections also reserves the right to cancel or reschedule any Shuttle service if the vehicle being used to transport guests will be less than half full. In this circumstance, Commencement Connections will refund all customers (guests) in full, and will do its best to notify guests as soon as possible.

5. If a Shuttle is cancelled by Commencement Connections due to circumstances beyond its reasonable control (e.g. weather, natural disaster), the customer (guest) is entitled to a 95% refund, which must be claimed within two (2) months of the purchase day. If Commencement Connections cancels all service for a Shuttle for any other reason, the customer (guest) is entitled to a full refund. Commencement Connections shall not be responsible for any other loss incurred by customer (guest) as a result of a cancellation or reschedule.

Please Note: late cancellations make it harder for Commencement Connections to design a smooth Shuttle schedule in the event of Severe Weather.

LIMITATION OF LIABILITY

YOU WAIVE AND COVENANT NOT TO ASSERT ANY CLAIMS OR ALLEGATIONS OF ANY NATURE WHATSOEVER AGAINST COMMENCEMENT CONNECTIONS, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS ARISING OUT OF OR IN ANY WAY RELATING TO YOUR USE OF THE SITE, THE SERVICES, THE CONTENT OR THE MATERIALS CONTAINED IN OR ACCESSIBLE THROUGH THE SITE, INCLUDING, WITHOUT LIMITATION, ANY CLAIMS OR ALLEGATIONS RELATING TO THE ALLEGED INFRINGEMENT OF PROPRIETARY RIGHTS, ALLEGED INACCURACY OF SITE CONTENT, OR ALLEGATIONS THAT COMMENCEMENT CONNECTIONS HAS OR SHOULD INDEMNIFY, DEFEND OR HOLD HARMLESS YOU OR ANY THIRD PARTY FROM ANY CLAIM OR ALLEGATION ARISING FROM YOUR USE OR OTHER EXPLOITATION OF THE SITE. YOU USE THE SITE AT YOUR OWN RISK.

WITHOUT LIMITATION OF THE FOREGOING, NEITHER COMMENCEMENT CONNECTIONS NOR ANY PARTIES PROVIDING SITE CONTENT SHALL BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE, THE SERVICES, THE CONTENT OR THE MATERIALS CONTAINED IN OR ACCESSIBLE THROUGH THE SITE, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM YOUR RELIANCE ON ANY SITE CONTENT OR OTHER INFORMATION OBTAINED FROM COMMENCEMENT CONNECTIONS OR ACCESSIBLE VIA THE SITE, OR THAT RESULT FROM MISTAKES, ERRORS, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO COMMENCEMENT CONNECTIONS INC. RECORDS, PROGRAMS OR SERVICES.

WITHOUT LIMITATION OF THE FOREGOING, COMMENCEMENT CONNECTIONS SHALL NOT BE LIABLE FOR ANY DIRECT, SPECIAL, PHYSICAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF PHYSICAL OR MENTAL CAPACITY, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH A SHUTTLE CHARTERED BY COMMENCEMENT CONNECTIONS ON ANY DAY, ANY YEAR AND MONTH. THE ENTITY WHICH OWNS THE SHUTTLES, PAYS THE LIABILITY, PHYSICAL DAMAGES, AND DRIVER INSURANCE, AND EMPLOYS THE DRIVERS, IS LIABLE AND RESPONSIBLE FOR ANY DAMAGES OF ANY KIND THAT ARISE WHEN CUSTOMERS (GUESTS) ARE OR ARE NOT BEING TRANSPORTED ON A SHUTTLE CHARTERED THROUGH COMMENCEMENT CONNECTIONS ON ANY DAY, ANY YEAR AND MONTH.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF COMMENCEMENT CONNECTIONS, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE SITE EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO COMMENCEMENT CONNECTIONS FOR ACCESS TO OR USE OF THE SITE.

BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Termination/Modification of License and Site Offerings

Notwithstanding any provision of these Site Terms, Commencement Connections reserves the right, without notice and in its sole discretion, without any notice or liability to you, to (a) terminate your license to use the Site, or any portion thereof; (b) block or prevent your future access to and use of all or any portion of the Site, Site Content or Services; (c) change, suspend or discontinue any aspect of the Site, Site Content or Services; and (d) impose limits on the Site, Site Content or Services.

Severability

If any provision of these Site Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Site Terms and shall not affect the validity and enforceability of any remaining provisions.
